Terms and Conditions
Francesca Muir asks you to please take the time to read the following carefully. Francesca Muir requires travellers to consider and accept the following Terms and Conditions prior to making a tour booking. If travellers do not accept these Terms and Conditions, please do not make a booking or pay a deposit.
By booking with Francesca Muir and paying the non-refundable deposit or full payment, a traveller acknowledges that they have read, understood and agree to be legally bound by these Terms and Conditions.
FM may amend these Terms and Conditions at any time. All amended terms and conditions are automatically effective upon being posted on our website or on our Facebook page.
You must check the website and Facebook page frequently for any changes to these Terms and Conditions.
If you have paid a deposit for a tour, FM will notify you as soon as possible of any changes.
Your deposit is non-refundable. The final payment for our tour is 1 February 2024. Reservations made after February 1 must be paid in full at the time of the reservation. Failure to pay the full amount by the due date may result in a cancellation at FM’s discretion.
Francesca Muir is not a tour operator.
Francesca Muir acts as “On Trip Tour Concierge” only and assists the tour travellers for the duration of the tour, with any selling and travel-related services, accepting reservations and booking for services, and managing the relationships between the traveller and registered Tour Operators and Guides where applicable.
Francesca Muir acts solely as agent in arranging tours and does not assume any liability for changes of flight times, fare changes, damage, loss of baggage, dishonour of airline, hotel or other reservations, delays, losses, injuries, inconveniences, cessation of operations, airline or tour bankruptcies, accidents, or for the acts of defaults of any person or entity engaged in conveying participants or in carrying out other arrangements of the tour.
Francesca Muir, therefore, shall not be responsible for breach of contract, failure to comply with any state or federal laws, or any intentional or negligent actions or omissions on the part of the Tour Operator and their suppliers, which result in any loss, damage, delay, inconvenience or injury to travellers or travellers’ companions or group members, or loss of income due to any mishaps. Without limiting the foregoing, if due to weather, flight schedules or other uncontrollable factors traveller is required to spend additional nights,
Francesca Muir will not be responsible for traveller’s hotel, transfers, meal costs or other expenses, not included on the supplied itinerary. Traveller’s baggage and personal property are completely at the traveller’s own risk.
Francesca Muir shall not be responsible for, and travellers hereby release Francesca Muir from, any claims, injuries, damages or other losses from any cause whatsoever, including but not limited to those in connection with terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, diseases, local laws, climate conditions, abnormal conditions or developments, or any other action, omissions, or conditions.
Travellers further assume complete and full responsibility for, and hereby release Francesca Muir from any duty of checking and verifying all passport, visa, vaccination, or other requirements of each destination, and all safety and security conditions of such destinations, during the length of the proposed travel. By embarking upon his/her travel, the traveller voluntarily assumes all risks involved in such travel—whether expected or unexpected, the traveller is hereby warned of these above-mentioned risks as well as possible travel industry bankruptcies/ medical/climatic disruptions, and the possibility that traveller/ travellers may be unable to travel as per the scheduled itinerary, due to any personal emergency which might arise.
Travel Insurance
It is a condition of joining Francesca Muir that you have appropriate cover, and the traveller is hereby advised to obtain comprehensive travel insurance coverage against these risks.
Francesca Muir suggests booking with a reputable travel insurance company.
Francesca Muir suggests that you book your travel insurance as soon as you book your flights to ensure you are covered in the event of a cancellation. (Don’t worry; you only pay insurance for the days you are on tour.)
Please email Francesca Muir a copy of your insurance policy as soon as purchased prior to your tour departure.
Passports
Please note your passport MUST be valid for MORE than 6 months FROM EXPIRY DATE and contain at least three blank pages.
Itinerary
Every effort will be made to adhere to the itinerary. However, in the event of unforeseen circumstances, Francesca Muir reserves the right to make changes to the itinerary and accommodation to ensure that you have the best Cretan experience.
Cancellation Policy
A cancellation charge is applicable on the following basis:
- A $900 non-refundable deposit is essential to secure you booking.
- If a booking is cancelled more than 61 before departure: 30% of the total tour cost is forfeited.
- If a booking is cancelled 60 – 46 days before departure: 50% of the total tour cost is forfeited.
- If a booking is cancelled 45 or fewer days before departure: 100% of the total tour cost is forfeited.
- All cancellations must be in writing.
